We operate exclusively in accordance with the Allgemeine Deutsche Spediteurbedingungen 2017 – ADSp 2017 – (German Freight Forwarders’ General Terms and Conditions 2017).

Note: In clause 23 the ADSp 2017 deviates from the statutory liability limitation in section 431 German Commercial Code (HGB) by limiting the liability for multimodal transportation with the involvement of sea carriage and an unknown damage location to 2 SDR/kg and, for the rest, the customary liability limi-tation of 8,33 SDR/kg additionally to Euro 1,25 million per damage claim and EUR 2,5 million per damage event, but not less than 2 SDR/kg.

The prices are to be treated in the strictest confidence. They include the fees for ancillary forwarding services and commissions pursuant to SST and are -as agreed- not carrying rates in accordance with HGB, para. 459 (forwarding at fixed costs), nor are they to be interpreted as such. They are valid on a prepaid basis and are considered to be non-binding until such time as a firm booking is made and our confirmation has been provided. They are based on the tariffs / terms, freight supplements and conversion rates valid today subject to shipment with partners of our choice and presuppose normal, unhindered forwarding circumstances. Any duties, taxes or valued added charges to be calculated are not included in the prices and will be charged additionally to the freight and costs offered.

Courier costs, loading and other local costs as well as terminal handling charges in the port of loading and discharge are not included in the prices offered. For containers a free loading, unloading and handling period of two hours is generally granted. It is deemed to have been mutually agreed that you are acting as our customer / merchant and not as our agent.

For all shipbroker operations we are acting exclusively on basis of the German Business Conditions for Shipbrokers and Shipping Agents, latest edition. Which are available upon request.
